Caesars Entertainment – Major Changes/Cancellation by Charter Participant

If you cancel your reservations, you will receive no refund, except under the limited circumstances set forth below. Notification of cancellation should be called either to the booking agent listed below or to our reservation department. Cancellation charges are effective from the day that you advise us of your cancellation and you receive a cancellation number.

i. You will be given a full refund if you cancel your reservation more than thirty (30) days before departure and we, or you, are able to re-fill the seats.

ii. Cancellation less than thirty (30) days prior to flight departure date will result in $250 per reservation cancellation fee. This fee will be charged to the credit card received at the time of booking or on file with Charter Operator, deducted from any refund due or if a valid credit card is not available or does not have sufficient funds, Charter Operator reserves the right to deduct Total Rewards Credits from primary customers account.

iii. You will be given a full refund, less a $25 per person service fee, if: (a) you provide a substitute charter participant for your reservation before canceling, provided, however, that charter participants who are complimentary guests of Charter Operator have no right of substitution, or (b) Charter Operator is able to resell your canceled reservation (as evidenced by a full manifest for the flight).

iv. You will be given a full refund if you cancel because: (a) of a medical emergency (physician’s note must be provided); (b) you or your companion decease before the departure (your “companion” is the person who is your confirmed scheduled roommate during the tour); or (c) of the death of an immediate family member (death certificate or other evidence must be provided).

v. If you are a comped passenger you will be required to secure your reservation with a major credit card. Your credit card will be charged the amount of $250 per reservation for the trip only if you fail to appear and participate in the charter. By signing this agreement, you agree to have your credit card charged accordingly.

vi. Delays due to weather-related issues will not constitute sufficient grounds for cancellation unless the new arrival or departure time is greater than four (4) hours from the original time or results in the flight departure moving to the next day.

vii. Any requests for a refund must be emailed or mailed to Caesars Entertainment by the individual who booked the reservation.

CANCELLATION AND REFUND: If you cancel your reservations you will receive no refund, except under the limited circumstances set forth below. Notification of cancellation should be called either to the booking agent listed below or to our reservation department. Cancellation charges are effective from the day that you advise us of your cancellation and you receive a cancellation number.

CANCELLATION NOTICE RECEIVED CANCELLATION/ADMINISTRATION FEE Passengers will forfeit their non-refundable $40 Convenience Fee if they cancel their reservation at anytime once it has been confirmed. An additional fee per passenger applies if the flight booking is changed or cancelled within 10 days of arrival to property or if the passenger is a no-show as described below. If a passenger does not have sufficient funds on their Credit Card for the fee, their Express Comps will be charged the fee.

The below changes made within 10 days of flight date will result in a $250.00 Cancel/Change fee charged to passengers who paid $250.00 or less for their flight.
Any amount previously paid for the flight will be deducted from the $250.00 fee and the balance will be due in full from the passenger at time of cancellation or change. Anyone paying more than $250.00 for their flight will forfeit all monies paid for the flight if cancelled or no-showed inside 10 days for the following reasons:

Changing booking from 2 passengers to 1 passenger resulting in loss of occupied seat within 10 days of flight date.

*Upon NM approval, adding a 2nd passenger to a single passenger booking and/or changing the second passenger’s name will not be charged a change fee even if done within 10 days of arrival.

CANCELLATION AND REFUND: If you cancel your reservations you will receive no refund, except under the limited circumstances set forth below. Notification of cancellation should be called in to our reservation department. Cancellations are effective from the day that you advise us of your cancellation and you receive a cancellation number. All requests for refunds must be sent to us in writing at the address listed under Charter Operator Information.

Except as specifically provided below, a non-refundable Twenty Five Dollar ($25.00) administration fee per person will be charged on all cancelled reservations.

Except as specifically provided below, if you cancel within 14 days or less prior to the flight, no refund will be issued. One Hundred Percent (100%) of the cost of the package will be retained by Peppermill Casinos Inc.
If you are a comped passenger you will be required to secure your reservation with a major credit card. Your credit card will be charged the amount of the trip per person for the trip only if you fail to appear and participate in the charter. Cancellations less than 14 days of the flight will be charged $25 per person. By signing this Agreement you agree to have your credit card charged accordingly.

If you cancel and we are able to resell your seat(s) you will receive a full refund less a $25.00 administrative fee; however, no such resale shall have occurred until all seats on the flight have been sold out initially. Alternatively, if at the time of cancellation you are able to provide a substitute passenger(s) to take over your reservation(s) for a travel package of equal or greater value, you will receive a full refund less a $25.00 administrative fee. Refunds will be made within 14 days of receipt of your notice of cancellation (or within 14 days of resale of your cancelled seat(s) as the case may be.)

Reservation Terms

You will be contacted to confirm your information and reservation request. Based upon availability and play history qualification, we will either confirm, deny or waitlist your reservation. Once we have confirmed your reservation, cancellation and change penalties will apply. Cancellation penalties and fees apply to all complimentary offers. Your credit card will not be charged until we are able to confirm your reservation.

Minimum Play Requirements apply to all reservations requests.

TOUR PARTICIPANT AGREEMENT

This agreement sets forth the terms and conditions under which Caesars Enterprise Services, LLC (“Charter Operator” or “we”) agrees to provide you the Charter Flight(s) included on your Tour & Travel Acknowledgment, which is incorporated by reference, in return for payment of the amount indicated as the total Charter Price.

1. General/Services

a. The Charter Price, Departure Date, Return Date, Origin City, Destination City and Tour Itinerary are set forth on your Tour & Travel Acknowledgment. Any tips or gratuities not specifically mentioned as included in the total Charter Price will be at your discretion. Except for “major changes,” as described below, no refund will be made for any accommodations or services included in the Charter Price which you voluntarily do not use.

b. This Charter Flight will be performed by either Sun Country Airlines using a Boeing 737 with a maximum of 160 public charter seats or Xtra Airways using a Boeing 737 with a maximum of 150 public charter seats or Elite Airways using a CRJ 200 or CRJ 700 with a maximum of 70 public charter seats or Ultimate Jet using a Dornier 328 with a maximum of 30 public charter seats. The air carrier reserves the right to substitute aircraft if necessary. Charter Operator reserves the right to substitute another air carrier if necessary.

c. Each charter participant is allowed to bring one (1) piece of checked baggage no larger than 62 inches in linear dimension or heavier than 50 lbs. (22 kilograms). No baggage fees will be charged for these allowances.

d. A credit card charge in the amount of the Charter Price and a signed contract is required to secure reservations.

e. Your payments are protected in part by a surety bond that Caesars Enterprise Services, LLC has obtained from Lexon Insurance Company of Texas. Unless you file a claim with us, or, if we are not available, with the securer, within 60 days after the completion of the Charter Flight, the securer will be released from all liability to you under the surety bond.

f. Trip cancellation, health, and accident insurance are available. We strongly recommend it. This important, low-cost protection can save you money if you are forced to cancel or alter your trip. If you are interested in receiving more information about this coverage, please contact CSA Travel Insurance and Assistance Services at (800) 348-9505 direct. Cancellation insurance is provided by independent third parties. Charter Operator, and/or its agents, do not guarantee payment under any cancellation insurance policy or the viability of an insurance company.

2. Major Changes/Cancellation by Charter Operator

a. If we make a major change prior to departure, you have the right to cancel and receive a full refund. The following are major changes: (1) a change in the departure or return date, unless the change results from a flight delay experienced by the air carrier (if, however, the delay is longer than 48 hours, it will be considered a major change); (2) a change in the origin or destination city, unless the change affects only the order in which cities named in a tour package are visited; (3) a substitute of any hotel not listed in this contract; and (4) a price increase of more than 10 percent occurring 10 or more days before departure. In no event can we increase your price less than 10 days before departure.

b. If a major change must be made in the program, we will notify you within 7 days after first learning of the change, but in any event at least 10 days prior to the scheduled departure. If, less than 10 days before scheduled departure, we become aware that a major change must be made, we will notify you as soon as possible. Within 7 days after receiving notification of a major change, but in no event later than departure, you may cancel your reservation and you will receive a full refund within 14 days after canceling. If a major change occurs after the departure of the flight which you are unwilling to accept, we will refund, within 14 days after your scheduled return date, that portion of your payment which applies to the services not accepted.

c. If we must cancel the charter, we will notify you by phone or in writing within 7 days of the cancellation, but in no event later than 10 days before the scheduled departure date. We have no right to cancel the charter less than 10 days before departure except for circumstances that make it physically impossible to perform the charter trip. If that occurs, we will notify you as soon as possible, but not later than the scheduled departure date. If the charter is canceled, we will make a full refund to you within 14 days after cancellation.

d. To the extent consistent with applicable laws and regulations, we may cancel any charter participant’s participation in a particular charter or charters at any time due to any of the following: (1) whenever such action is necessary to comply with any government regulation, directive, or request; (2) if the charter participant refuses to permit the search of his or her person or property for explosives or a dangerous weapon or article or for any other security-related reason; (3) if the charter participant refuses to produce identification that reflects the same full name information displayed on their participant’s tour contract; (4) if a charter participant fails or refuses to comply with the rules, regulations, and conditions of carriage of the Air Carrier; (5) when cancellation may be necessary for a charter participant’s safety or the safety of other charter participants in the event that a charter participant: (a) displays disorderly, abusive, or violent behavior (other than that involving a qualified disabled individual whose appearance or involuntary behavior may offend, annoy, or inconvenience other charter participants or crew members); (b) is barefoot; (c) is unable or unwilling to sit in an aircraft seat with the seat-belt fastened; (d) appears intoxicated or under the influence of drugs (other than a qualified disabled individual whose appearance or involuntary behavior may make them appear to be intoxicated or under the influence of drugs); (e) has a malodorous condition (other than individuals qualifying as disabled); (f) attempts to interfere with any Charter Operator personnel or member of Air Carrier’s flight crew in the performance of their duties; (g) is seriously ill and fails to provide a physician’s written permission to participate in the tour; (h) is blind, deaf and unaccompanied, unless such charter participant is able to communicate with Charter Operator and/or Air Carrier representatives by physical, mechanical, electronic, or other means; (i) requires unusual or unreasonable assistance or medical treatment during the tour, unless such charter participant is accompanied by another charter participant capable of providing the necessary assistance or medical treatment; (j) is unwilling or unable to comply with no-smoking requirements; and (k) has a mental disability that renders them unable to comprehend or respond to safety-related instructions, unless such charter participant is accompanied by another charter participant; or (l) is known to have a communicable disease or infection 2

which has been determined, by the U.S. Surgeon General, the Centers for Disease Control and Prevention, or other public health authority knowledgeable about the disease or infection, to be transmissible to other persons in the normal course of the tour. If, however, the charter participant with the communicable disease or infection presents a medical certificate giving approval to travel and stating any conditions for travel, we shall allow the charter participant to participate in the tour unless it is not feasible to implement the conditions set forth in the medical certificate as necessary to prevent the transmission of the disease or infection to other persons in the normal course of the tour. Charter Operator is not liable for its cancellation of any charter participant’s tour participant contract in accordance with the terms of this paragraph, but will, at the request of the charter participant, refund the amount of any unused portion of the tour price in accordance with its refund policies. Charter Operator will not be responsible for compensatory or punitive damages and a refund will be a charter participant’s exclusive remedy.

3. Major Changes/Cancellation by Charter Participant

1. Cancellations under 2 hours of flight time or failure to check-in for flight will not qualify for a refund except for reasons stated in section 3.iv.

iv. You will be given a full refund if you cancel because: (a) of a medical emergency (physician’s note must be provided); (b) you or your companion decease before the departure (your “companion” is the person who is your confirmed scheduled roommate during the tour); or (c) of the death of an immediate family member (death certificate or other evidence must be provided).

4. Liability

a. Charter Operator as the principal, is responsible to you for arranging and providing all of the services and accommodations offered in connection with these charter flights, provided, however, that in the absence of negligence on Charter Operator’s part, Charter Operator is not responsible for personal injury, property damage, or other loss or expense caused by the air carrier, any other hotel, or supplier(s) of any of the other services being offered or provided in connection with the Charter Flight.

b. For all domestic Charter Flights, the air carrier’s liability is limited to $3,400.00 per passenger total, for checked and unchecked baggage. For all international Charter Flights, the air carrier’s liability is limited to 1131 Special Drawing Rights per passenger total, for checked and unchecked baggage. A passenger will be compensated for provable direct or consequential damages resulting from the disappearance of, damage, to, or delay in delivery of a passenger’s baggage that was in the air carrier’s custody up to the limit of liability, provided the passenger has made reasonable effort to minimize the amount of damage. Actual value for reimbursement of lost or damaged property will be determined by the documented original purchase price less any applicable depreciation.

RIGHTS AND REMEDIES: The rights and remedies made available under this contract are in addition to any other rights or remedies available under applicable law. However, we offer refunds under this contract with the express understanding that the receipt of that refund by a passenger waives the additional remedies.

INTERNATIONAL FLIGHTS: For international flights, the operation of the flights is subject to the foreign governments involved granting landing rights for the flights. If the air carrier cannot obtain these rights, the flight will be canceled; and a full refund will be made to you automatically.

OPERATOR-PARTICIPANT CONTRACT

This agreement sets forth the terms and conditions under which we Peppermill Casinos Inc. in return for payment of the amount indicated as the total charter price, agree to provide you this charter flight.

RESPONSIBILITY: Peppermill Casinos Inc., as principals, are responsible to you for arranging and providing all of the services and accommodations offered in connection with these charter flights, provided, however, that in the absence of negligence on Peppermill Casinos Inc., Peppermill Casinos Inc. are not responsible for personal injury or property damage or other loss or expense caused by the air carrier, hotel, or other supplier(s) of any of the other services being offered or provided in connection with the charter.

RESERVATIONS AND PAYMENT: Payment of the Charter Price and a signed contract is required to secure reservations. If the charter is fully booked when your reservation is received, your payment will be returned within 7 days, or with your authorization, we can retain the deposit and place your name on a waiting list in case other passengers cancel their reservations. Even if you authorize us to put your name on a waiting list, we will notify you within 7 days that your selected flight is fully booked.

All checks, money orders, and credit card payments must be made payable to Peppermill Casino Escrow.

CHARTER PRICE: The charter price, Departure Date, Return Date, Origin City, Destination City and Tour Itinerary are set forth on the Tour and Travel Acknowledgment attached. BAGGAGE: For each ticketed passenger, XP will transport as checked baggage free of charge one (1) bag not to exceed 62 inches in overall linear dimensions (length plus width plus height), and the weight of which is not to exceed 50 pounds. Passengers may also carry on without charge, one (1) additional bag totaling no more than 45 inches in overall linear dimensions, and weighing no more than 40 pounds, which is capable of being stowed under a passenger seat, in an overhead compartment, or in an empty passenger seat. An extra charge applies for additional, overweight (baggage exceeding 50 pounds), and/or baggage that exceed 62 inches in overall dimensions. Special items such as boxed items, surfboards, bicycles, etc. will be handled at the discretion of XP and, if permitted, are subject to an extra charge. All baggage accepted is at the discretion of XP and subject to structural and performance limitations of the aircraft. Golf clubs are not permitted.

Baggage Claim Limits and Procedures 1. General: Liability for loss, damage, or delay of baggage is limited as follows unless the passenger declares a higher value in advance and pays additional charges: a. For most international travel (including domestic portions of international journeys), liability is limited to 1,131 Special Drawing Rights; b. For travel wholly between U.S. points, total liability for provable direct damages only resulting from the loss, delay or damage in XP’s custody is limited to UNCONTROLLED COPY WHEN DOWNLOADED OR PRINTED TEM ENTERPRISES Xtra Airways Contract of Carriage Chapter One Revision: 12 24AUG15 Page 18 of 20 $3,400.00 per ticketed passenger, unless a higher value is declared in advance and additional charges are paid. NOTE: XP will have no liability for any loss, damage or delay of checked or carry-on baggage unless a claim is reported to an XP authorized air carrier representative before leaving the destination airport. Also, it should be noted that in the course of normal handling, baggage may show evidence of wear and tear. XP assumes no liability for minor damage, or for protruding parts not limited to straps, handles, wheels, and luggage feet. H. When XP has exercised ordinary care, it shall not be liable for delay in delivery of any perishables, nor for damage to or damage caused by fragile items, liquids or perishables that are unsuitably packed, and that are included in a passenger’s checked baggage, with or without XP’s knowledge. XP may allow a passenger to check fragile and/or perishable items that are unsuitably packed upon the execution of a Liability Release. I. If XP accepts checked baggage less than fifteen (15) minutes prior to the scheduled departure time, XP will not be liable for any expenses incurred, including delivery expenses, should there be a delay in delivery of the baggage. NOTE: When transportation is via XP and one or more air carriers with different limitations of liability, the lowest maximum baggage liability will apply. J. Excess Valuation: Baggage liability is limited to those amounts set forth in the above terms, unless an additional charge is paid. The excess valuation charges and maximum value allowed can be obtained from XP’s Corporate Office. The additional protection (excess valuation) is not available for and does not cover loss of, damage to or delay in delivery of: money, precious metals, jewelry, cameras, video and electronic equipment, silverware, negotiable papers, securities, business documents, samples, paintings and other works of art, antiques, artifacts, fragile articles, musical instruments and other similar valuable items and commercial effects. K. Responsibility: XP assumes responsibility only for those claims arising from the transportation of baggage over its own routes. All claims are subject to proof of value and loss. L. Interim Expenses: XP will not normally pay any interim expenses during the first 24 hours in the case of delayed baggage. If under extraordinary circumstances, the passenger requires interim expense money (for clothing, tools, medicine, etc.) during the first 24 hours, such payment will be made upon management approval only. 1. When the first 24 hours has elapsed and the delayed or lost baggage has not been located, at the request of the passenger, XP will pay up to a maximum of $25.00 for interim expenses. Any request for an amount in excess of $25.00 will be referred to the Corporate Office. 2. Interim expenses are usually not paid if the passenger resides at a locality near the origination airport. CRAFT: This flight will be performed by Xtra Airways using a 737-400 Series Aircraft with a maximum of 150 public charter seats. The air carrier reserves the right to substitute equivalent aircraft if necessary. SECURITY AGREEMENT: Your payments are protected in part by a surety bond that Peppermill Casinos Inc has obtained from Fidelity & Deposit Company of Maryland.

Unless you file a claim with us, or, if we are not available, with the securer within 60 days after the completion of the charter, the securer will be released from all liability to you under the security agreement.

CANCELLATION AND REFUND: If you cancel your reservations: you WILL RECEIVE NO REFUND EXCEPT UNDER THE LIMITED CIRCUMSTANCES SET FORTH BELOW, notification of cancellation should be called in to our reservation department. Cancellations are effective from the day that you advise us of your cancellation and you receive a cancellation number. All requests for refunds must be sent to us in writing at the address listed under Charter Operator Information. (see below)

Except as specifically provided below, a non-refundable Twenty Five Dollar ($25.00) administration fee per person will be charged on all cancelled reservations.

Except as specifically provided below, if you cancel within 14 days or less prior to the flight, no refund will be issued. One Hundred Percent (100%) of the cost of the package will be retained by Peppermill Casinos Inc.

If you are a comped passenger you will be required to secure your reservation with a major credit card. Your credit card will be charged the amount of the trip per person for the trip only if you fail to appear and participate in the charter. Cancellations less than 14 days of the flight will be charged $25 per person. By signing this Agreement you agree to have your credit card charged accordingly.

Please be sure to call our Reservations Department to notify us of your cancellation. Administration fees (if any) are effective from the day that you advise

If you cancel and we are able to resell your seat(s) you will receive a full refund less a $25.00 administrative fee; however, no such resale shall have occurred until all seats on the flight have been sold out initially. Alternatively, if at the time of cancellation you are able to provide a substitute passenger(s) to take over your reservation(s) for a travel package of equal or greater value, you will receive a full refund less a $25.00 administrative fee. Refunds will be made within 14 days of receipt of your notice of cancellation (or within 14 days of resale of your cancelled seat(s) as the case may be.)

If we make major changes prior to departure: you have the right to cancel and receive a full refund. The following are major changes: (1) a change in the departure or return date, unless the change results from a flight delay experienced by the air carrier. (If, however, the delay is longer than 48 hours, it will be considered a major change.) (2) a change in the origin or destination city, unless the change affects only the order in which cities named in a tour package are visited; (3) a substitute of any hotel not listed in this contract; and (4) a price increase of more than 10 percent occurring 10 or more days before departure. In no event can we increase your price less than 10 days before departure. If a major change must be made in the program, we will notify you within 7 days after first learning of the change, but in any event at least 10 days prior to the scheduled departure. If, less than 10 days before scheduled departure, we become aware that a major change must be made, we will notify you as soon as possible. Within 7 days after receiving notification of a major change, but in no event later than departure, you may cancel your reservation and you will receive a full refund within 14 days after cancelling.

If a major change occurs after the departure of the flight, which you are unwilling to accept, we will refund, within 14 days after your scheduled return date, that portion of your payment, which applies to the services, not accepted.

If we must cancel the charter: we will notify you in writing within 7 days of the cancellation, but in no event later than 10 days before the scheduled departure date. We have no right to cancel the charter less than 10 days before departure, except for circumstances that make it physically impossible to perform the charter trip. If that occurs, we will notify you as soon as possible, but not later than the scheduled departure date. If the charter is canceled, we will make a full refund to you within 14 days after cancellation.

The rights and remedies made available under this contract are in addition to any other rights or remedies available under applicable law. However, we offer refunds under this contract with the express understanding that the receipt of that refund by a passenger waives the additional remedies.

INTERNATIONAL FLIGHTS: The operation of these flights is subject to the foreign governments involved granting landing rights for the flight. If the air carrier cannot obtain these rights, the flight will be canceled and a full refund will be made to you automatically.

BEAU RIVAGE RESORT & CASINO RESORT TOUR & TRAVEL PROGRAM CONSUMER OPERATOR PARTICIPATION CONTRACT (COPC)

This agreement sets forth the terms and conditions under which Beau Rivage Resorts, Inc., (hereinafter referred to as “BEAU RIVAGE” or “We”), a Mississippi corporation, with its principal place of business located at 875 Beach Boulevard, Biloxi, Mississippi 39530, as Public Charter Operator agrees to coordinate with MN Airlines, LLC d/b/a Sun Country Airlines (hereinafter referred to as “SUN COUNTRY”), a Minnesota corporation, as the Direct Air Carrier, to provide this charter flight on your behalf in return for payment of the amount indicated as the total charter price.

RESPONSIBILITY: BEAU RIVAGE as the principal, is responsible to you for providing all of the services and accommodations offered in connection with these charter flights, provided, however, that in the absence of negligence on the part of SUN COUNTRY, either on its own or through BEAU RIVAGE, as its agent, it is not responsible for personal injury, property damage, or other loss or expense caused by the air carrier, any other hotel, or supplier(s) of any of the other services being offered or provided in connection with the charter.

RESERVATIONS AND PAYMENT: Payment of the Charter Price and a signed Consumer Operator Participation Contract (COPC) is required to secure reservations. If the charter is fully booked when your reservation is received, your payment will be returned, or with your authorization, we can retain the deposit and place your name on a waiting list in case other passengers cancel their reservations. Even if you authorize us to put your name on a waiting list, we will notify you within seven (7) days that your selected flight is fully booked.

CHARTER PRICE: The Charter Price, Departure Date, Return Date, Origin City, Destination City and Tour Itinerary are set forth on the Tour & Travel Acknowledgment attached. Any tips or gratuities not specifically mentioned as included in the total charter price will be at your discretion. Except for “major changes,” as described below, no refund will be made for any accommodations or services included in the charter price which you voluntarily do not use.

BAGGAGE: The Direct Air Carrier, as defined below, allows each passenger to bring on the flight (e.g., 1 piece of checked baggage no larger than 62 inches total dimensions or heavier than 70 pounds (32 kilograms). For INTERNATIONAL flights, the air carrier’s liability is limited to the actual value of the baggage but not more than $9.07 per pound ($20 per kilogram) in the case of checked baggage and approximately $400.00 per passenger for unchecked baggage. Unless the actual weight is entered on the baggage check, each piece of checked baggage is presumed to weigh 32 kilograms and, accordingly, the air carrier’s liability is limited to $640 per piece. For DOMESTIC flights, the carrier’s liability is limited to $3,000.00 per passenger total, for checked and unchecked baggage.

AIRCRAFT: This flight will be performed by SUN COUNTRY (“Direct Air Carrier”). A 737-700 aircraft will be used with a maximum capacity of 126 public charter seats. The Direct Air Carrier reserves the right to substitute equivalent aircraft if necessary.

SECURITY AGREEMENT: To the extent payment is required, please contact BEAU RIVAGE Customer Care at (888) 640-8973, and a BEAU RIVAGE representative will coordinate with you to ensure that payments are made payable and deposited to the charter escrow account at Penn Liberty Bank, 747 West Lancaster Ave., Ste. 210, Wayne, PA 19087. Your payments are protected by a surety agreement issued by Fidelity and Deposit Company of Maryland, 3910 Keswick Rd., Baltimore, MD 21211. Unless you file a claim with SUN COUNTRY or BEAU RIVAGE, or, if neither of us is available, with the securer within 60 days after the completion of the charter, the securer will be released from all liability to you under the security agreement. If there is no return flight in your itinerary, completion means the date or intended date of departure of the last flight in your itinerary. CANCELLATION AND REFUND: If you cancel your reservations you will receive no refund, except under the limited circumstances set forth below. Notification of cancellation should be called either to the booking agent listed below or to our reservation department. Cancellation charges are effective from the day that you advise us of your cancellation and you receive a cancellation number.

CANCELLATION NOTICE RECEIVED CANCELLATION/ADMINISTRATION FEE

Passengers will forfeit their non-refundable $40 Convenience Fee if they cancel their reservation at anytime once it has been confirmed. An additional fee per passenger applies if the flight booking is changed or cancelled within 10 days of arrival to property or if the passenger is a no-show as described below. If a passenger does not have sufficient funds on their Credit Card for the fee, their Express Comps will be charged the fee.

The below changes made within 10 days of flight date will result in a $250.00 Cancel/Change fee charged to passengers who paid $250.00 or less for their flight. Any amount previously paid for the flight will be deducted from the $250.00 fee and the balance will be due in full from the passenger at time of cancellation or change. Anyone paying more than $250.00 for their flight will forfeit all monies paid for the flight if cancelled or no-showed inside 10 days for the following reasons: ? Changing/Cancelling Flight Day ? Changing/Cancelling Flight City ? Changing booking from 2 passengers to 1 passenger resulting in loss of occupied seat within 10 days of flight date. *Upon NM approval, adding a 2 nd passenger to a single passenger booking and/or changing the second passenger’s name will not be charged a change fee even if done within 10 days of arrival.

The following provides your cancellation rights in the event of a “major change” to the charter program as defined herein. The following are major changes: (1) a change in the departure or return date, unless the change results from a flight delay experienced by the Air Carrier (if, however, the delay is longer than 48 hours, it will be considered a major change); (2) a change in the origin or destination city, unless the change affects only the order in which cities named in a tour package are visited; (3) a substitute of any hotel not listed in this contract; and (4) a price increase of more than 10 percent occurring ten (10) or more days before departure. In no event can we increase your price less than ten (10) days before departure.

If, less than ten (10) days before scheduled departure, we become aware that a major change must be made, we will notify you as soon as possible. Within seven (7) days after receiving notification of a major change, but in no event later than departure, you may cancel your reservation and you will receive a full refund. If a major change occurs after the departure of the flight which you are unwilling to accept, we will refund, within fourteen (14) days after your scheduled return date, that portion of your payment which applies to the services not accepted.

If we must cancel the charter, we will notify you in writing within seven (7) days of the cancellation, but in no event later than fourteen (14) days before the scheduled departure date. We have no right to cancel the charter less than fourteen (14) days before departure except for circumstances that make it physically impossible to perform the charter trip. If that occurs, we will notify you as soon as possible, but not later than the scheduled departure date. If the charter is canceled, we will make a full refund to you.
